Should Bestiality Be Legal?

Germany is considering a ban on bestiality – the practice of having sex with animals.

…wait, what was that? That must mean that Germany…doesn’t currently…ban sex with animals…

What the duck!? Germany, a modern, important and civilised country currently allows people to legally have sex with animals! 

I’m sorry, I don’t usually take this kind of enraged blogging attitude to writing articles for Allied Newspapers, but this is truly bizarre – how can Germany currently not legally prohibit sex with animals? While I’m not as avid an animal rights campaigner as many protesting against the current legislation in place, I do, I think quite rightly, subscribe, as most people do, to the premise that sex should be consensual. In the same way that a child is not legally able to give consent to sexual activities, neither can an animal. Sure, animals may or may not become as traumatized as cogent human children become through non-consensual sex with an adult human – I doubt we know for sure if an animal gets psychological scarred by sex with a macabre German man – but I’m also pretty sure that they’re not keen on it.

An explicit ban is being proposed that will allow those culpable of this sickening (in my mind anyway) action to be given sentences in prison (and hopefully some genuine psychological help) for their bizarre deed. This makes sense – at the moment, it is only illegal to have sex with an animal if harm is found to have come to the animal. This is the situation in the UK where guilty offenders can face up to two years in prison. And yet, there are those against the ban, willing to preserve their right to…have sex with animals.

“It is unthinkable that any sexual act with an animal is punished without proof that the animal has come to any harm,” said Michael Kiok of the pressure group Zeta (Zoophile Engagement for Tolerance and Information…oh my.)

Here’s another thing: the act remains permissible in Belgium, Denmark and Sweden…what the cow!? Those defending zoophilia say that animals are able to indicate that they want to be raped by human beings – that it actually is consensual. Oh, great, well if that’s the case, let’s have the animals vote on the bill too…oh no wait, we say they aren’t able to give consent to political views…but they can give consent to human beings having sex with them and forcing them to have sex with other animals?

“The cow gave a positive moo to my naked thrusting”…I doubt this can really stand up in court as consent.

Animals simply cannot give consent to Germans, Swedes and whoever else having is sex with them. Within a consistent legal set-up, bestiality should be illegal for the same reasons as rape and pedophilia.  That this consistency does not exist in Germany and other countries is quite frankly shocking.
